Sendlove Online Gift Shop – Operated by Amakia Enterprises Private Limited
1. Definitions
- “Shipper” refers to any individual or entity engaged by Sendlove.co.zw to facilitate product collection and delivery.
- “Platform” refers to Sendlove.co.zw, operated by Amakia Enterprises Private Limited.
- “Seller” refers to third-party vendors listing products on the Platform.
- “Buyer” refers to customers purchasing products through the Platform.
2. Shipper Obligations
2.1 Order Fulfillment
- Upon notification from the Platform, Shipper must:
- Collect payment (where applicable) from Sendlove.co.zw.
- Pay the Seller and obtain the product(s).
- Deliver products to the Buyer’s specified address within the agreed timeframe.
2.2 Delivery Standards
- All deliveries must be executed:
- Safely and securely (proper and original packaging by the seller – to prevent damage).
- Within the stipulated timeframe (as communicated by the Platform).
- With proof of delivery (signed receipt or digital confirmation).
2.3 Communication
- Shipper must provide real-time updates to the Platform regarding:
- Collection status.
- Delivery progress.
- Any delays or issues.
- A WhatsApp group between the Platform, Shipper and Seller will be used to provide this feedback.
3. Payment & Compensation
3.1 Payment Structure
- Shipper will be compensated per delivery or batch of deliveries as per the agreed rate with Sendlove.co.zw.
- Bulk payments will be processed at agreed intervals (daily, weekly, or fortnightly).
3.2 Deductions & Adjustments
- Compensation may be adjusted for:
- Failed deliveries due to Shipper negligence.
- Damaged products caused by improper handling.
4. Liability & Insurance
4.1 Product Liability
- Shipper is responsible for safe handling and transport of products.
- Any damage or loss during transit (due to Shipper’s actions) will result in liability for replacement costs.
4.2 Insurance
- Shipper is encouraged to maintain third-party liability insurance for high-value shipments.
- Sendlove.co.zw is not liable for Shipper’s uninsured losses.
5. Termination
5.1 By Shipper
- Shipper may terminate this agreement with 7 days’ written notice, provided all pending deliveries are completed.
5.2 By Sendlove.co.zw
- The Platform may suspend or terminate a Shipper’s engagement for:
- Repeated delivery failures.
- Violation of these terms.
- Fraudulent activity.
- Termination will be communicated in writing.
6. Dispute Resolution
- Unresolved disputes between Shipper and Platform will be referred to:
- Mediation (via Platform’s customer service).
- Zimbabwean courts if mediation fails.
7. Governing Law
These terms are governed by Zimbabwean laws, including:
- Road Traffic Act (Chapter 13:11) (for transport compliance).
8. Amendments
- Sendlove.co.zw may update these terms with 30 days’ notice.
- Continued services constitute acceptance.
Acceptance
By agreeing to provide delivery services for Sendlove.co.zw, Shipper agrees to these terms unconditionally.
